British Citizenship for EU Nationals


Hello everyone, so today I will be talking
about EU Nationals and the route to naturalisation. So I will be talking about the position before
brexit and then I’ll be talking about the position after brexit (whenever that will
be!) – So the position before brexit is that the
EU national must obtain a document certifying permanent residency before they can apply
for naturalisation in the UK. This document must be obtained before they
can apply for naturalisation, as otherwise the application will be refused. So when can they apply for the document certifying
permanent residency? Well as long as they have been living in the
UK continuously for at least 5 years and they were exercising their treaty rights during
those 5 years then they can apply for the document certifying permanent residency, and
then they would need to wait at least a year after they’ve had that document before they
can then apply for naturalisation. If an EU national has been living in the UK
for more than 6 years and they were exercising treaty rights during that period of 6 years
or more, then as soon as they obtained the document certifying permanent residency they
can just apply for naturalisation straight away. – They don’t have to wait for a year before
they they’ve had the document certifying permanent residency before they can then apply for naturalisation. So to summarise, EU nationals route to naturalisation
if they’ve been here for 5 years and then they obtained the document certifying permanent
residency then they need to wait another year before they can apply for naturalisation. – Or if they’ve been living in the UK for
6 years and they were exercising treaty rights for all of those years, then as soon as they
obtained the document certifying permanent residency, they can apply for naturalisation. So when brexit happens (I don’t know when),
but when it eventually happens then the new document will then be the settled status document. So that will replace the document certifying
permanent residency and basically the requirements will be the same in terms of the route to
naturalisation. So 5 years of having leave to remain here
in the UK and then one year of having the settle status document before applying for
naturalisation. Or 6 years of living in the UK and then obtaining
the settled status document and then they can apply straightaway for naturalisation. Thank you…
