Citizens Fighting Back Against Speed Traps and Tickets


We came to Doraville after we were
contacted by a resident who had received some outrageous property code tickets
and after we started investigating we realized that Doraville was one of the
most prolific ticket writers in the country, and certainly in the Atlanta
area and that was according to an investigation by the local newspaper here. Hilda Brucker was fined $100 and sentenced to criminal probation because of the condition of this driveway. Hilda was hauled into Doraville Municipal
Court without warning and told she faced three criminal misdemeanor charges for
the condition of her property. I was called into court with no warning, and I was sentenced for having cracks and crumbles in my driveway, which is so ridiculous and ludicrous. No one ever asked me to fix the driveway, this is a neighborhood of very old driveways. Who does that? And you received a criminal citation for the driveway? Yes it was, it was a criminal charge against me. I then met Hilda’s neighbor, Jeff Thornton, who was ticketed for a stack of wood which he used for wood working. This is the remains of that wood pile, it’s deplenished quite a bit since then because I’ve used it for woodworking or cooking. I’ve made a few birdhouses out of this wood because the the roof looks really neat with the rough wood. It ran along the fence, and it was
nice and neatly stacked and actually some of it had a tarp over so you
couldn’t see how ugly it looked, apparently. Even before this happened to me, I would be out on my morning walk and I would see code enforcement officers skulking around people’s front yards, taking pictures. Jeff I saw you nodding. Yes I’ve seen that as well, I’ve been the recipient of it as well. Just to see them taking pictures of my yard and say hey what’s going on? Doraville is notorious for its speed traps and other law enforcement activities because it sits on the Atlanta Beltway, the perimeter, which gives its police the opportunity to ticket commuters who are making their
way to the Atlanta area, and this city is heavily reliant on the fines and fees it gets from those tickets. Doraville relies on fines and fees to
generate about a quarter of its general operating budget, that means that city
officials and law enforcement officers have a financial incentive to ticket and
convict both property owners and drivers. A judge can’t have a financial interest in a case that comes before them, and a prosecutor can’t have a financial interest in prosecuting the cases that come before them, they have to be neutral government officers. You shouldn’t feel threatened to the point
where you’re almost afraid to drive in certain areas, not because it’s dangerous,
but because you might just be a trigger for somebody who’s out there patrolling
to make money. If you have a city, you need to be able to fund the city and it shouldn’t be something where you have to penalize your citizens, or people who are
visiting the city in order to be able to keep the city up and running. Across the country, we see courts and cities that continue to use their criminal justice systems to generate revenues, this practice is unconstitutional and the Institute for Justice has filed suit here in another leg in its journey to stop it.

    The State of Georgia should revoke Doraville's charter and disband all city government to include the police force. Let the County Sheriffs office take over law enforcement for that area.

    Good – make them spend a half million dollars or so to defend their illegal practice.  This is being said by a former police officer who would not have fallen in line with this policy.  I would have followed the same principles I did serving my community.  If a ticket was deserved, a ticket would have been issued.  We called them citations.

    They have the right idea in Honolulu. All cop cars are required to have their blue light on (not flashing) when an officer is in the car. They got rid of the "hide in the bushes cops". Good people.

    So why do you people keep voting in the city council over and over and voting in majors that think alike over and over again? The majority of the council is liberal, the Mayor was once a council member voted into mayor is liberal. Keep voting them in over and over and over again. Until that changes enjoy being nickel and dimes to death.

    Vote vote vote mayor out of office to get rid of Police Chief..! Promote a need for mayor candidates running on Pro-Citizens “We the People” platform and Go door to door asking for votes..! Grassroots style of politics will eventually generate change of law enforcement going after law abiding citizens for technicalities BS fines..!

    Revenue generators by use of police officers fining citizens for silly infractions is bad business developing totalitarian police state.

    I can't say anything for the property code we are just getting one side of the story. I like how the don't have any one from the city comment about why or what code they violated. But as for the speed and traffic tickets fallow the speed limit and the other rules of the road and you have nothing to worry about. oh I know the big bad police officer stopped me I was only doing 15 to 20 MPH over but  who are they to stop me

    In order for this to have been pulled off multiple City agencies, including the court, would have had to conspire with each other in order to be successful at this hideous tactic. What dirty people you have running your city. My father would have called them "dirty dogs".

    In DeKalb County, GA 79.1% of the people voted Democrat in the last presidential election, 16.2% voted Republican, and the remaining 4.7% voted Independent. That explains the whole issue!

    In order for those people to get ticketed unfairly police have to be willing to break the very oath they took when they became officers. Think about it. I'd sooner quit than violate the rights of my neighbors if stuck with that choice to make. It's disgusting to watch America become this!

    You folks need to go to White House TN their town runs UNDER highway 65 just north of Nashville, but their officers are constantly on the highway writing speeding citations. it got to the point the state government was considering a state law requiring only cities of over a certain size be allowed to enter the federal highway system to enforce traffic laws unless the offense is within their jurisdiction and the auto is followed upon the highway…the bill never passed and I do not know why

    This is a touchy subject. We have a problem with “code enforcement” and “traffic enforcement “. Traffic tickets are always thought of as intrusive, nobody thinks they do anything so wrong that they should be pulled over, yet there isn’t a driver out there that does not complain about the “other guy” doing stupid things. Not one driver out there does not complain about how stupid other drivers are. Obviously, somebody is wrong! We can all see fault in another drivers actions while ignoring our own. Maybe one solution would be that the revenue from all traffic tickets be dispersed to other jurisdictions far away from whatever county or town the citation was issued. That could reduce the appearance of “revenue collection” for any particular area. Another solution might be to eliminate the fines associated with traffic tickets. Points alone will cost drivers, yet not Benefit your local Mayor and legislators. Jussayin!

    We should do a citizen's arrest on ALL the officer's, judges, and prosecutors, who fined, penalized, arrested, and/or hauled into court citizens, then haul THEM into court and throw in jail for unconstitutionally breaking the law. THEN, when they say, "But but but, we didn't know it was unconstitutional and against the law to do this!, we just tell them the same thing they tell us, "Ignorance of the law is no excuse, sorry, not sorry."

    over about a 7 year period my last landlord extorted 50 grand from me and my parents. i have in my possession PROOF of this extortion. I notified the L. A. police and, since the extortion involved crossing state lines, the fbi. neither gave a damn. I notified my and my parents banks to report the extortion and demand an investigation. they did nothing. i notified about 10 attorneys and not one would represent me because i'm poor. ALL 3 of California landlords have violated their leases and committed criminal fraud. I've notified dozens of govt agencies and lawyers but no one gives a shit. so where does a poor person like me turn for justice?

    I would say that ticking/slowing down out-of-towners who speed thru your small community IS both protecting and serving the citizens of Doraville. As far as ticketing home owners over somewhat trivial things, can the city raise property taxes whenever they want? Or are they blocked by state government?

    I raise very large dogs and have as many as 10 very large dogs around my property my property is fenced so that these very large dogs cannot leave and harm somebody had a code enforcement person decide to just randomly come through a gate that was secured but not locked I won’t get into detail what happened to him but I don’t think anyone will ever come to my house again without a phone call first I have subsequently put Fencing material that blocks the view onto the property I only have 2 acres fenced off they can roam the other 10 if they want but every now and then I’ll let one of my dogs out just to make sure everything is on the up and up I’ve installed cameras and I don’t think I’ll be bothered by anybody in the future you need to push back on the scumbags hard

    Our family makes all its tourism spending decisions by internet videos about a locality to know its availability of public services and quality of life there. "DUMB" Doraville just made the top of the IGNORE & AVOID list. Our band/families converted tour bus full of tourist dollars will NEVER see that town !!! Thank You Very Much !!

    When it comes to stuff like this the Citizens need to come together and find violations on town-owned property or property owned by officials, so it shows clear violations in cases that are probably not getting attention by code enforcement.

    At first I thought this was going to be rich peeps complaining about advertised enforcement but this is way out of control. A lot of places like Texas also have a Draconian Traffic violation policy in which police and courts conspire to drive up revenues from unnecessary traffic stops. In Texas you have to have a jury trial for a traffic ticket unless you want to make a deal or just pay it. You don’t get to face the cop who charged you until a jury trial. Murderers are allowed to have a bench trial… Like WTF…
    And if you lose the jury trial over a speeding ticket you have to pay exorbitant court costs in addition to the full retail price of the original ticket.
    So most people can’t afford to fight the ticket and so they make a deal with the judge who might take the ticket down a little. In other words you don’t really get to face your accuser unless you have really deep pockets.
