Policing for Profit – The Abuse of Civil Asset Forfeiture


If police suspect that you committed a crime
they can arrest you and put you on trial. At that trial prosecutors must prove you’re
guilty beyond a reasonable doubt. But if police suspect that your car was involved in a
crime, they can take it, sell it, and in most places pocket the proceeds
to pad their budgets. They need not prove you committed any crime
or even arrest you to take your property away. Welcome to the upside-down world of civil
asset forfeiture. With civil forfeiture your property is guilty
until you prove it innocent to get it back, and because most state and federal laws allow
police and prosecutors to pocket the proceeds, they have a big incentive to pursue profits, not justice. How big? In 1986 the Justice Department’s
forfeiture fund took in 94 million dollars. Now it has more than a billion. State and local agencies receive forfeiture funds, too, but we don’t know how much because most states
don’t publicly report on forfeiture. No surprise abuse is rampant. One New York police department spent forfeiture funds
on food, gifts and entertainment. In Georgia, forfeiture funds paid for football tickets
for a DA’s office, and the DA in Texas used forfeiture dollars to buy TV ads for his re-election
campaign. Meanwhile citizens are seeing cash, cars, and other property taken away for the
flimsiest of reasons. Carrying too much cash? Police can accuse you of selling drugs or
laundering money and seize it. No conviction or even arrest required. An Institute
for Justice study graded state laws on how well they protect people from wrongful forfeitures. Only 3 states received a B or better. The rest range from mediocre to awful and so does federal law. Worse the federal legal loophole allows police
and prosecutors to bypass state protection and keep pocketing forfeiture money. IJ’s research shows that the easier and more profitable
these laws make forfeiture, the more it is used and abused. It’s time to end civil forfeiture People shouldn’t have their property taken
away without being convicted of a crime, and law enforcement shouldn’t be policing for
profit.

    I'm a victim of civil forfeiture. What can I do? I'v hired lawyers and contacted the ACLU, I'v also got ahold of local representatives. I tried to get ahold of the people who run fear . org but I had no luck there I even went as far as sending my testimonial (available upon request) to the infowars website. please let me know of any avenues i should take. thank you for your time.

    This has been going on for decades in the states via the drug war.
    Canada is about to make law minimum mandatory sentences for small amounts of pot, in 2010! as america almost legalizes it!?

    In canada police can also Already take your stuff no charge: Civil Remedies Act' just like vid.

    CBC said all phones can be tapped for an emergency since 1999 (before 911 excuse) But there's no Oversight or records kept!!!

    There would be nothing wrong with private police forces "policing for profit", it only goes wrong when state police starts to do so, not for company economic profit but for corrupt profit. Two different things entirely.

    @fuzzmew Nah, don't use violence, that is their game. Rather, we have to start breaking their rules peacefully. Just hang on awhile longer. What is happening in Greece and Egypt and Syria will come here. When there are hundreds of thousands of people breaking the rules, they won't be able to do anything about it because they'll be broke.

    My mother in law paid cash for her brand new automobile why pay extra to the finance company. So it's not a crime to carry large sums of cash if cops take cash with no proof person did a crime they are thieves plain and simple.

    Yeah they got bankruptcy laws to protect the rich I heard it cost $1500 to file for bankruptcy and pay for a good attorney, many poor people don't have $1500. Multibillion dollar corporations often bankrupt many with overprice housing and car loans, etc. and the people they bankrupt are screwed but they (banks, loan, and car companies) get bailed out when they go bankrupt.

    If that car was registered then it means you are in a trust with the STATE inc. You are the trustee of the thing in equity. You have 9/10ths equitable title and the STATE incorporation has 1/10th legal title. Consequently if you signed up for the benefit of driving, you agree to be regulated under the motor vehicle code in commerce. So it's their car you are driving if you registered it. The tag is the state flag in admiralty.

    I think people should start to fight back. There are over 300,000,000 Americans and about 800,000 law enforcement . If we all come to the aid of people being attacked by pig, they don't stand a chance. put race aside and think American citizen . First, NEVER HELP THEM BY BEING A WITNESS!     This is the beginning of the media propaganda to "fix" forfeiture laws. Simply requiring a conviction before law enforcement seizes a persons property will also be misused by police. Every quote you read about seizures says basically this: "We use these laws to take the profit away from all these organized rackets and dope peddlers". How about a conviction for a crime in which the convicted actually PROFITED from the crime?

    As it stands now, a huge list of illegal activites, any of which a LEO can provide proof beyond a preponderence of the evidence (the civil court burden), allows for seizure of a citizens property:

    You see, contrary to all of the "talking points", law enforcement can seize property from otherwise innocent citizens, not because the are PROFITING from crime, but simply committing a crime.

    Can you say "double jeopardy"? Our sham government has pulled the wool over our eyes and now, in the name of "fixing" things, they are only invonveniencing law enforcement a little bit more.

    The point that really stings our local honorable LEO community is not that they are going to require a conviction before stealing from the peons, its that the money will go to the state general fund. That is unacceptable. Then how will they drive those cool cars saying "taken from a drug dealer" when the person they took the vehicle from was never charged nor convicted of being a "drug dealer"

    Oklahoma state police now have a devise in there cars that allowed then to take your bank card or any card and see what's in your account and if they think maybe you have done something wrong they can withdraw all your savings, and your employee pay if you have direct deposit. The money is taken off your card and transferred to an account the state has. You no longer have to have cash on you because all your accounts are free game to!!!
